Product Warranty Terms and Conditions
For consumers, who are covered by consumer protection laws or regulations in their country of purchase or, if difference, their country of residence, the benefits conferred by our Warranty are in addition to all rights and remedies conveyed by such consumer protection laws and regulations, including but not limited to these additional rights.
Our products are warranted against defects in materials and workmanship for a period of ONE (1) YEAR from the date of the original retail purchase (“Warranty Period”). All products undergo stringent quality control testing. They are warranted to be free from material defects, when you return the product in accordance with this warranty and our instructions. This warranty applies to normal use for the intended purpose of the product, under normal conditions.
This warranty excludes normal depletion of consumable parts such as batteries unless failure has occurred due to a defect in materials or workmanship and, damage resulting from abuse, accident, modification, unauthorised repairs or other causes that are not defects in materials and workmanship.
ROAM do not warrant, represent or undertake that it will be able to replace any product under this warranty without risk to and/or loss of information and/or data stored on the product. In no event shall ROAM be liable for (a) loss or damage, which as of the product’s purchase cannot be regarded as being caused by ROAM’s breach of theses warranty terms; or (b) losses caused by the user’s fault, loss of data or loss of profits or benefits.
If a defect arises during the warranty period, ROAM, at its option will (1) exchange the product with a product with equivalent functionality formed from new and/or used parts that are equivalent to new in performance and reliability or with your consent, a product that is at least functionally equivalent to the product it replaces, or (2) refund the original purchase price.
This warranty does not cover the damages resulting from improper installation, accidents, abuse, misuse, or improper care, nor does it cover minor cosmetic damages due to normal “wear and tear” of the product.
We reserve the right to make changes in design, materials and specifications without obligation to notify any individual or entity. If the product fails under normal usage, please contact us on instructions on how to return he defective product.
Be sure to have your proof of purchase on hand; return requests cannot be processed without proof of purchase. We do not cover shipping, insurance or any import fees, duties and taxes for the returned product. If after inspection we find the product to be defective in materials or workmanship, we will at our option and at no cost repair or replace the defective product with the same or comparable product on a commercially reasonable effort basis. In no event shall our liability exceed the paid price for the product.
This warranty does not cover, and we will not have any liability to you for, any incidental or consequential damages caused by using the product. This warranty gives you specific legal rights. You may have other additional rights depending on where you live.
ROAM make no other warranty regarding the product, and we disclaim all other warranties, expressed, statutory or implied, including any implied warranty merchantability, fitness for a particular purpose, no-infringement, or arising or course of dealing or trade usage. This constitutes your sole exclusive remedy, and our sole and exclusive liability, for breach of this warranty.
Any limitations or liability in this warranty document shall not apply to (i) death or personal injury pursuant to any mandatory law on product liability; (ii) fraud or fraudulent misrepresentation; (iii) International misconduct or negligence; (iv) or a culpable breach of major contractual obligations. A damages claim based on breach of major contractual obligations or gross negligence will be limited to foreseeable damage typical for the sale contract concerned.
Under UK consumer law, consumers may choose to have defective goods or goods which do not conform with the contract sale replaced free of charge. If a replacement is not possible, would impose a disproportionate burden on the seller, or could not be performed in a reasonable time and without significant inconvenience to the consumer, the consumer may choose to have the price reduced or withdraw from the contract by returning the product in exchange for a refund. A consumer is also entitled to withdraw from the contract by returning the product in exchange for a full refund if the consumer rejects the goods within 30 days or if the product does not conform, with the contract after one repair or replacement. The primary responsibility to provide a remedy is on the seller, which would be ROAM if the goods were purchased from our online store. If the goods were purchased from a third party reseller, the primary responsibility to provide a remedy will lie with the reseller. For goods purchased in England or Wales, these rights expire six years from delivery of the goods. For goods purchased in Scotland, these rights expire five years from delivery of the goods. A claim under UK consumer law may be subject to the defect being present at the time of purchase.
Any defects or non-conformity of goods with the contract which becomes apparent within six months of delivery is presumed to have existed at the time of delivery. After the expiry of this six month period, the burden to prove that the defect or non-conformity of goods with the contract existed on delivery generally shifts to the consumer.
IMPORTANT INFORMATION FOR HEADPHONES
IMPORTANT – Please note that headphones of any type are non-refundable due to hygiene reasons, of the packaging is opened or the seals are broken in any way. This does not affect your statutory rights, if returned under warranty and the goods are found to be defective.
For unopened products ONLY, ROAM will make the reimbursement without undue delay, and not later than: (a) 14 days after the day we receive back from you any goods supplied, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the goods.
ROAM will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement but you will have to bear the direct cost of returning the goods.
You shall send back the goods to ROAM, Unit 12, Arrowhead Rd, Theale, Berkshire, RG7 4AH or contact us (email: email@example.com Telephone: 0118 912 6250) without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days have expired.
ALL RETURNS MUST HAVE A VALID RETURNS REQUEST NUMBER TO BE PROCESSED.
You do have the statutory right to return warranty product to ROAM Technologies. However in this instance ROAM will need to verify that the product qualifies as a warranty return, not a customer damaged or unwanted product which will not be refunded. In the event that we accept the warranty, a replacement or repaired item will be sent in its place.
